Official Raffle Terms & Conditions and Release of Liability

By purchasing a ticket for the Three Rivers Trout Unlimited Raffle ("Raffle"), participants agree to be bound by the following official rules, terms, and conditions:

1. Prize Acceptance & Ownership Transfer The grand prize consists of one (1) inflatable fishing raft and one (1) boat trailer (collectively, the "Prize"), with an approximate retail value of $10,500 USD. The Prize is awarded "AS IS, WHERE IS, AND WITH ALL FAULTS." Neither Three Rivers Trout Unlimited, Trout Unlimited, Inc., nor their respective officers, directors, employees, members, agents, or volunteers (collectively, the "Released Parties") make any express or implied warranties, representations, or guarantees regarding the condition, quality, safety, merchantability, or fitness for a particular purpose of the raft or trailer. Upon transfer of ownership, title, or physical possession, full legal responsibility and ownership of the Prize immediately vest in the winner.

2. Comprehensive Assumption of Risk The winner acknowledges that the operation, transport, towing, storage, and use of an inflatable raft and trailer involve inherent risks, including but not limited to equipment failure, property damage, bodily injury, catastrophic accident, or death. The winner voluntarily assumes all risks, known or unknown, associated with the acceptance, transport, maintenance, towing, and watercraft operation of the Prize from the moment of possession onward.

3. Total Release of Liability & Indemnification To the fullest extent permitted by law, the winner agrees to forever release, waive, discharge, hold harmless, and fully indemnify the Released Parties from any and all claims, liabilities, lawsuits, damages, losses, costs, or expenses (including reasonable legal fees) arising directly or indirectly out of:

  • The acceptance, transport, towing, hitching, unhitching, storage, or operation of the raft or trailer;

  • Any vehicular accidents, collisions, traffic incidents, or highway mishaps involving the trailer or raft;

  • Any inherent or hidden manufacturing, mechanical, or structural defects in the raft, trailer, or accompanying equipment;

  • Any personal injury, death, or property damage sustained by the winner, passengers, or third parties resulting from the use or misuse of the Prize.

4. Licensing, Registration, and Taxes The winner is solely responsible for all federal, state, and local taxes, as well as all fees associated with licensing, registering, titling, inspecting, insuring, and legally operating the trailer and watercraft. The Released Parties will not provide insurance, hitching assistance, or warranties of state trailer compliance.
